These Terms and Conditions govern your use of cryospheron's services and website. By accessing our website or booking any of our winter tourism services, you acknowledge that you have read, understood, and agree to be bound by these terms. This agreement constitutes a legally binding contract between you and cryospheron.

2. Definitions

For the purposes of this agreement:

  • "Services" refers to all winter tourism experiences, travel arrangements, tours, expeditions, and related services provided by cryospheron.
  • "User," "You," or "Client" refers to any individual or entity accessing our website or booking our services.
  • "Company," "We," "Us," or "Our" refers to cryospheron and its authorized representatives.
  • "Content" includes all text, images, itineraries, destination information, and materials provided on our website or in connection with our services.
  • "Agreement" refers to these Terms and Conditions along with any additional booking confirmations or service-specific terms.

3. Use of Services

Our services are available to individuals who are at least 18 years of age and have the legal capacity to enter into binding contracts. By booking our services, you represent that you meet these requirements and that all information provided during the booking process is accurate and complete.

You are responsible for maintaining the confidentiality of any account information and for all activities that occur under your account. You agree to notify us immediately of any unauthorized use of your account or any other breach of security.

4. Prohibited Uses

You agree not to use our services or website to:

  • Violate any applicable laws, regulations, or third-party rights
  • Infringe upon any intellectual property rights, including copyrights, trademarks, or patents
  • Transmit any malicious code, viruses, or harmful software
  • Attempt unauthorized access to our systems, servers, or networks
  • Engage in fraudulent activities or misrepresent your identity
  • Harass, abuse, or harm other users or our staff
  • Use automated systems or scripts to access or collect information from our website
  • Resell or commercially exploit our services without explicit written authorization

5. Booking and Reservations

All bookings are subject to availability and confirmation. A booking is confirmed only when you receive written confirmation from cryospheron. We reserve the right to refuse any booking at our discretion.

Pricing for our services is displayed in Singapore Dollars (SGD) unless otherwise specified. All prices are subject to change without prior notice until a booking is confirmed. Once confirmed, the agreed-upon price will remain fixed for that specific booking.

6. Intellectual Property

All content on our website, including but not limited to text, graphics, logos, images, itineraries, destination guides, and software, is the property of cryospheron or its content suppliers and is protected by international copyright laws.

We grant you a limited, non-exclusive, non-transferable license to access and use our website for personal, non-commercial purposes. You may not reproduce, distribute, modify, or create derivative works from our content without express written permission.

Any content you submit to us, including reviews, testimonials, or feedback, grants us a perpetual, worldwide, royalty-free license to use, reproduce, modify, and display such content in connection with our business operations.

7. Payment Terms

Payment for services must be made in Singapore Dollars (SGD) unless alternative arrangements are agreed upon in writing. We accept payment via bank transfer, credit card, and other methods as specified during booking.

A deposit is typically required at the time of booking, with the balance due according to the schedule specified in your booking confirmation. Full payment must be received no later than 45 days before the scheduled departure date, or the booking may be canceled.

We reserve the right to modify our pricing at any time. However, price changes will not affect bookings that have already been confirmed. All applicable taxes, service charges, and fees are included in the quoted price unless otherwise stated.

8. Cancellation and Refund Policy

Cancellations must be submitted in writing to [email protected]. The following cancellation charges apply:

  • More than 60 days before departure: 25% of total booking value
  • 45-60 days before departure: 50% of total booking value
  • 30-44 days before departure: 75% of total booking value
  • Less than 30 days before departure: 100% of total booking value (no refund)

Refunds, if applicable, will be processed within 14-21 business days from the date of approval. The refund will be issued to the original payment method used for booking.

Certain services, including but not limited to specially arranged expeditions, chartered transport, or non-refundable accommodation bookings, may be subject to different cancellation terms, which will be clearly communicated at the time of booking.

9. Travel Documentation and Insurance

You are solely responsible for ensuring that you possess valid travel documents, including passports, visas, and any required health certificates. We strongly recommend that all travelers obtain comprehensive travel insurance covering trip cancellation, medical emergencies, evacuation, and personal liability.

cryospheron is not responsible for any costs, losses, or damages arising from inadequate travel documentation or lack of appropriate insurance coverage.

10. Health and Safety

Winter tourism in extreme cold climates involves inherent risks. You acknowledge that you are physically and mentally fit to participate in the activities included in your itinerary. You must disclose any medical conditions, dietary requirements, or physical limitations that may affect your ability to participate safely.

We reserve the right to refuse participation or terminate services for any traveler whose condition or behavior poses a risk to themselves, other travelers, or our staff.

11. Disclaimers and Limitations of Liability

Our services are provided "as is" without warranties of any kind, either express or implied. While we strive to ensure accuracy in our itineraries and destination information, we do not guarantee that services will be uninterrupted, error-free, or meet your specific expectations.

We are not liable for delays, cancellations, or modifications to itineraries caused by weather conditions, natural disasters, political instability, civil unrest, labor disputes, or other circumstances beyond our reasonable control.

To the maximum extent permitted by law, our total liability for any claims arising from your use of our services shall not exceed the amount paid by you for the specific service in question. We shall not be liable for any indirect, incidental, consequential, or punitive damages.

You acknowledge and accept the risks inherent in adventure travel and winter tourism. By participating in our services, you assume all risks associated with such activities.

12. Force Majeure

Neither party shall be liable for any failure to perform its obligations under this agreement if such failure is caused by circumstances beyond its reasonable control, including but not limited to acts of God, natural disasters, epidemics, pandemics, government restrictions, war, terrorism, or labor disputes.

In the event of force majeure, we will work with you to reschedule your travel or offer alternative arrangements where possible. However, we cannot guarantee refunds for circumstances outside our control.

13. Changes to Itineraries

We reserve the right to modify itineraries, substitute accommodations, or adjust services when necessary for operational reasons, safety concerns, or circumstances beyond our control. We will notify you of significant changes as soon as reasonably possible.

Minor alterations to itineraries do not entitle you to compensation or refunds. However, if substantial changes occur that significantly affect the nature of your trip, you may be offered an alternative arrangement or a partial refund.

14. Termination

We reserve the right to terminate this agreement and your access to our services immediately if you breach any provision of these Terms and Conditions. Upon termination, you must cease all use of our services and website.

You may terminate this agreement at any time by ceasing to use our services, subject to the cancellation policy outlined in Section 8.

The following provisions shall survive termination: intellectual property rights, payment obligations, limitations of liability, and dispute resolution clauses.

15. Dispute Resolution

In the event of any dispute arising from or relating to this agreement, both parties agree to first attempt to resolve the matter through good-faith negotiation.

If informal resolution is unsuccessful within 30 days, the dispute shall be referred to mediation before an agreed-upon neutral mediator. Both parties shall share the costs of mediation equally.

If mediation fails to resolve the dispute, either party may pursue arbitration or legal proceedings. This agreement shall be governed by and construed in accordance with the laws of Singapore. Any legal proceedings shall be subject to the exclusive jurisdiction of the courts of Singapore.

16. Privacy and Data Protection

Your privacy is important to us. Our collection, use, and protection of your personal information are governed by our Privacy Policy, which can be found at Privacy Policy. By using our services, you also consent to our privacy practices.

17. General Provisions

These Terms and Conditions, together with our Privacy Policy and any booking confirmations, constitute the entire agreement between you and cryospheron regarding your use of our services.

If any provision of this agreement is found to be invalid or unenforceable, the remaining provisions shall continue in full force and effect.

Our failure to enforce any right or provision of these terms shall not constitute a waiver of that right or provision.

You may not assign or transfer your rights or obligations under this agreement without our prior written consent. We may assign our rights and obligations to any affiliate or successor entity.

18. Modifications to Terms

We reserve the right to modify these Terms and Conditions at any time. Changes will be effective immediately upon posting to our website. Your continued use of our services after any modifications constitutes acceptance of the revised terms.

We will update the "Last Updated" date at the top of this page to reflect when changes were made. We encourage you to review these terms periodically.
